Quite rightly too, as discussed previously, the identity of the victim is irrelevant. As Justice Leach stated, you wouldn't downgrade the culprit of a bomb attack because they didn't know the identities of the people that would be killed.

I struggled from the start to understand how "I thought I was killing someone else" could be a defence against a murder charge.

No. He's still to be re-sentenced, then there's a possibility that he may now appeal against the new decision.RoryoftheRovers wrote:This means the whole thread is now redundant right?

Think the consensus is there's no grounds for an appeal.Rover the Top wrote:No. He's still to be re-sentenced, then there's a possibility that he may now appeal against the new decision.RoryoftheRovers wrote:This means the whole thread is now redundant right?

Pistorius denied leave to appeal the murder conviction. He'll be sentenced next month.

He sort of has been already. He's currently out on bail having already been released from prison after the original sentence. But the murder conviction will stand now.Gibbon wrote:He'll be released before he gets sentenced at this rate.

Re: Pistorius trial.
So having had her original verdict overturned to a crime carrying a minimum sentence of 15 years in prison, the judge sentences Pistorius to... 6 years.
I anticipate another appeal from the prosecution.
